Terms & Conditions

Gowiings provides an online platform that enables customers to discover restaurants, place orders, and receive food delivery services. By joining Gowiings, the Restaurant authorizes Gowiings to list and promote its business on the platform.

The Restaurant confirms that:

• It is legally authorized to operate.
• It holds a valid FSSAI license and all required permits.
• All information submitted to Gowiings is accurate and up to date.
• It will promptly notify Gowiings of any changes to licenses, ownership, contact details, or business operations.

The Restaurant agrees to:

• Maintain food safety and hygiene standards.
• Use fresh and safe ingredients.
• Prepare orders within reasonable timelines.
• Provide accurate menu descriptions and pricing.
• Update unavailable items promptly.
• Package food securely and appropriately.
• Comply with all applicable laws and regulations.

The Restaurant shall be solely responsible for the quality, preparation, ingredients, packaging, and safety of all food products sold through Gowiings.

Gowiings may:

• Display the Restaurant's menu and information.
• Facilitate customer orders.
• Process customer payments.
• Arrange delivery services through delivery partners.
• Promote the Restaurant through marketing activities.
• Provide operational and technical support.

Gowiings reserves the right to modify platform features and services from time to time.

The Restaurant agrees to pay the commission and other applicable fees communicated by Gowiings through the dashboard, onboarding process, commercial schedule, or written communication.

Applicable charges may include:

• Platform commission
• Delivery charges
• Marketing charges
• Promotional campaign contributions
• Technology fees
• Applicable taxes

All fees are subject to applicable GST and other taxes as required by law.

Gowiings shall settle payments to the Restaurant on every Tuesday for all successfully completed and eligible orders from the previous settlement period.

Payments shall be settled through the Restaurant's registered bank account or preferred payment method provided during registration and maintained in the Restaurant Partner account. The Restaurant is responsible for ensuring that all payment details remain accurate and up to date.

Gowiings may deduct the following amounts before settlement:

• Platform commission
• Applicable taxes
• Customer refunds
• Chargebacks
• Promotional contributions
• Marketing fees
• Delivery-related adjustments
• Other agreed deductions

Settlement reports and transaction details shall be made available through the Gowiings platform or communicated electronically.

The Restaurant shall determine menu pricing unless otherwise agreed.

Participation in discounts, campaigns, and promotional offers may be voluntary or based on mutually agreed commercial arrangements.

The Restaurant authorizes Gowiings to display menu prices, promotional offers, discounts, logos, trademarks, and photographs on the platform.

Where delivery services are provided by Gowiings:

• The Restaurant shall hand over orders on time.
• The Restaurant shall use suitable packaging.
• The Restaurant shall cooperate with delivery partners.
• The Restaurant shall ensure that all items in the order are complete and correctly packed.

The Restaurant shall remain responsible for food quality and order accuracy until the order is handed over to the delivery partner.

The Restaurant shall comply with:

• Food Safety and Standards Act, 2006
• FSSAI regulations
• GST laws
• Consumer protection laws
• Local municipal requirements
• Any other applicable laws and regulations

Gowiings may suspend listings where food safety concerns arise.

Customers may provide ratings and reviews regarding their experience.

Gowiings may remove fraudulent, abusive, misleading, offensive, or inappropriate reviews.

Repeated poor ratings, customer complaints, or quality concerns may result in corrective action, suspension, or termination.

The Restaurant retains ownership of its trademarks, branding, menu content, photographs, and business identity.

The Restaurant grants Gowiings a non-exclusive, royalty-free license to use its logos, menu information, images, trademarks, and branding for platform operations and promotional purposes during the term of the partnership.

Customer information shared through the platform shall only be used for fulfilling orders.

The Restaurant shall not:

• Sell customer data.
• Share customer data with third parties without authorization.
• Use customer information for unauthorized marketing activities.

Both parties shall comply with applicable data protection and privacy laws.

Both parties agree to keep confidential any non-public business, operational, technical, financial, commercial, or customer information received during the partnership.

This obligation shall survive termination of the relationship.

Neither party shall be liable for delays or failures caused by events beyond reasonable control, including:

• Natural disasters
• Floods
• Earthquakes
• Pandemics
• Government restrictions
• Internet outages
• Strikes
• Civil disturbances

These Terms shall be governed by and construed in accordance with the laws of India.

The Parties shall first attempt to resolve disputes through mutual discussions.

If a dispute remains unresolved, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996.

The seat and venue of arbitration shall be Sagar, Madhya Pradesh, India.

Subject to arbitration provisions, courts located in Sagar, Madhya Pradesh shall have exclusive jurisdiction.

By clicking "I Agree," creating a Restaurant Partner account, submitting onboarding documents, accepting orders through the platform, or continuing to use the Gowiings Restaurant Partner Platform, the Restaurant confirms that it has read, understood, and accepted these Terms & Conditions.
